National Modern Award

From 1 January 2010, the Hospitality Industry (General) Award 2010 (the ‘HIGA’) replaced the Hotels, Clubs Etc. NAPSA, the Clerks (Clubs, Hotels and Motels) NAPSA and the Liquor and Accommodation Industry – Hotels, Resorts and Gaming – (Managerial Staff) Award 2003.

Who is covered by the HIGA from 1 January 2010?
> All Constitutional Corporations; and
> The management staff of Non-Constitutional Corporations if they were previously covered by the transitional Liquor and Accommodation Industry – Hotels, Resorts and Gaming – (Managerial Staff) Award 2003 (the ‘Federal Managers Award’).

The HIGA applies to the hospitality industry which includes hotels; motor inns and motels; boarding establishments; condominiums and establishments of a like nature; health or recreational farms; private hotels, guest houses, serviced apartments; caravan parks; ski lodges; holiday flats or units, ranches or farms; hostels, or any other type of residential or tourist accommodation; wine saloons, wine bars or taverns; liquor booths; resorts; caterers, casinos; and function areas and convention or like facilities operating in association with the aforementioned.

It does not apply to restaurants, reception centres, night clubs, cafes and roadhouses which are covered by the Restaurant Industry Award 2010.

Note 1: If your hotel applies the AHA/LHMU Industry Collective Agreement, staff covered by this agreement are not covered by the HIGA. The Agreement will continue to apply until it is replaced by a new Agreement or formally rescinded. Staff at these facilities who are not covered by the collective agreement (eg. clerical and management staff) will now be covered by the HIGA instead of the relevant NAPSA/Federal Award.

Note 2: Employees who earn more than $113,800 per annum are not covered by the HIGA or any other modern award. These employees are still covered by the National Employment Standards.
